Driving Under the Influence in Illinois

Driving under the influence can have serious consequences on your life. If your livelihood depends on you driving to and from work, driving for work, such as with a Commercial Driver's License (CDL), or relying on reliable transportation, you may find yourself out of work if you receive a DUI conviction.

Receiving a DUI is a misdemeanor in Illinois and goes on your record. For a first offense, you can face up to 364 days in jail, $2,500 in fines, or a combination of both. Based on certain factors, your driver’s license may be suspended for a period of 6 months to 1 year. If you receive a second or third DUI offense, the jail time and fine stay the same, but your license will be suspended for a minimum of 5 or 10 years. A DUI is one of the only convictions that cannot be expunged or sealed from your record. It will stay on your record for public view for the rest of your life.

If you are under 21, or hold a CDL and receive a DUI, you are held to a stricter standard and may face harsher consequences. Illinois has a zero tolerance for under age drinking and driving. If you are driving a commercial motor vehicle, the blood alcohol content (BAC) limit is 0.04%, while an average adult’s BAC limit is 0.08%.

Illinois is considered an implied consent state. If you refuse to take a BAC test, you are admitting guilt and an officer can arrest you and immediately suspend your license.
