Drug offenses in Illinois involve the possession, sale, distribution, cultivation, manufacture, and trafficking in such controlled substances as marijuana, cocaine, heroin, LSD, morphine, methamphetamines, steroids, and similar narcotics. The severity of the criminal charges you face will depend on the quantity of drugs involved, any previous convictions, and factors such as whether weapons were involved in the crime or whether you sold drugs within 1500 feet of a school, public park, or other public place where minors may congregate.
It is also a crime in the state to possess or distribute unauthorized prescription drugs, otherwise known as prescription drug fraud. Drugs which are commonly part of such crimes are prescription painkillers, such as Vicodin (hydrocodone) and OxyContin (oxycodone) or other medical drugs such as Percocet, Valium, and Xanax. Prescription drug fraud may be committed by altering prescriptions, impersonating medical personnel in calling in prescriptions, creating false prescriptions, through doctor shopping and other means. Prescription drug fraud is a crime committed by people in all walks of life, many of whom have become addicted. It is generally charged as a felony and may result in heavy fines and prison sentences.
Unless it is a small amount of marijuana, most drug crimes are charged as felonies, with penalties increasing the greater the amount that is found. In many drug possession charges, possible defenses can be based on illegal search and seizure and other flaws or inconsistencies in the case. Even with less than 2.5 grams of marijuana, you face a potential jail sentence of up to 30 days and fines of up to $1,500. In some cases of marijuana possession, you may be eligible for a drug education or treatment program which may result in a dismissal of charges.
